TERMS & CONDITIONS

1. Acceptance
By registering for or purchasing any product or program offered by Institute of Business Coaching Pty Ltd ("IOBC", "we", "us", "our"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms form a binding contractual agreement between you and IOBC.
We may change these Terms at any time by notifying you. Your continued participation in or use of any IOBC program following such notification will represent your agreement to be bound by the updated Terms.
2. Definitions
In these Terms, unless the context requires otherwise:
- "Cancellation" means the cessation of your registration for a program or workshop prior to its Commencement Date.
- "Commencement Date" means the date on which your registered program or workshop begins.
- "Deferral" means the postponement of your registration to a new Commencement Date prior to the original Commencement Date.
- "Program" means any IOBC multi-day certification or training course.
- "Workshop" means any IOBC event of less than one day's duration, whether paid or free.
- "Services" means all programs, workshops, events, and related services delivered by IOBC.
- "Participant" means any individual registered to attend an IOBC program or workshop.
- Words in the singular include the plural and vice versa; references to currency are references to Australian dollars.
3. Registration and Account Accuracy
When you register for any IOBC program or event, you will be required to provide personal and professional details including your name, email address, phone number, billing address, and professional background.
You warrant that all information you provide to IOBC in the course of registration or at any time during your participation is accurate, honest, correct, and up to date. IOBC may, in its absolute discretion, decline to accept or continue a registration.
4. Programs and Enrolment
- Enrolment in any IOBC program is confirmed upon receipt of full payment.
- IOBC reserves the right to decline enrolment at its discretion without obligation to provide reasons.
- Program dates, facilitators, content, and formats may be subject to change. IOBC will provide reasonable written notice of any material changes.
- IOBC reserves the right to change, update, or vary the nature of any program from time to time by providing 30 days' written notice to enrolled participants.
4.1 Delivery Format Variation
Due to unforeseen circumstances — including but not limited to venue unavailability, public health requirements, or other factors outside IOBC's reasonable control — the format of a pre-booked program may be subject to change at IOBC's discretion. This may result in a change from in-person to virtual delivery, or vice versa.
IOBC will communicate any necessary changes to delivery format in writing as far in advance of the Commencement Date as practicable. IOBC excludes all liability for any travel, accommodation, or associated expenses incurred by participants where a format change has been communicated prior to the Commencement Date.
5. Fees and Payment
All program fees are as published on the IOBC website at the time of registration.
5.1 GST
Unless otherwise indicated, all fees quoted are exclusive of Goods and Services Tax (GST). Where GST applies, IOBC will provide a valid tax invoice and you must pay the GST amount in addition to the program fee.
5.2 Pricing Errors
In the event that IOBC discovers an error or inaccuracy in the price at which a program was purchased, we will contact you as soon as reasonably practicable. You will then have the option to:
- Proceed with enrolment at the correct price; or
- Cancel your registration and receive a full refund of any amount already paid.
6. Refund and Cancellation Policy
All requests for Cancellation must be submitted in writing to IOBC at [email]. Verbal notification to IOBC staff or agents is not valid and will not be accepted. Requests are only effective from the date and time they are received in writing.
6.1 Free Events
No payment is taken for free events and no refund is applicable.
6.2 Paid Workshops
The following terms apply to all paid IOBC workshops, regardless of price or title. Current workshop fees are as published on the IOBC website at the time of registration.

6.3 Certification Programs
The following terms apply to all IOBC multi-day certification programs. Current program fees are as published on the IOBC website at the time of registration.

Note: Any credit issued by IOBC is valid for 6 months from the date of issue. Credits not redeemed within this period will expire with no further entitlement.
6.4 Deferral
Participants in a Certification Program may request a Deferral to a future intake in lieu of Cancellation. Deferral requests must be submitted in writing to [email] and must include a nominated new Commencement Date. The following conditions apply:
- Deferral requests received 21 or more days before the Commencement Date: permitted at no charge.
- Deferral requests received 8–20 days before the Commencement Date: a deferral fee of 25% of the program registration fee applies.
- Deferral requests received 7 days or less before the Commencement Date: not permitted. The standard Cancellation policy applies.
- If a new Commencement Date is not provided with the Deferral request, IOBC reserves the right to process the request as a Cancellation.
- If the program fee has increased at the time of the deferred intake, the participant will be required to pay the difference.
6.5 Special Consideration
Participants who are unable to attend due to illness, injury, bereavement, jury duty, or other genuine misadventure may apply for special consideration, even where the standard Cancellation or Deferral policy would not otherwise provide relief.
To apply, contact IOBC at [email] as soon as reasonably practicable, and provide relevant documentary evidence (for example, a medical certificate, hospital letter, or other supporting documentation). Special consideration requests are reviewed on a case-by-case basis at IOBC's discretion. Approval is not guaranteed and IOBC may request additional information before making a determination.
Note: Last-minute work commitments, conflicting meetings, or personal scheduling changes do not qualify as misadventure for the purposes of this clause.
6.6 Transfers
You may transfer your place to another eligible participant with 5 or more business days' written notice prior to the Commencement Date, at no charge.
6.7 Cancellation by IOBC
If IOBC cancels a program, you will receive a full refund or the option to transfer to the next available intake. IOBC is not liable for any travel, accommodation, or other costs incurred by participants as a result of a program cancellation.
6.8 Australian Consumer Law
If a program fails to meet a consumer guarantee under the Australian Consumer Law, you are entitled to a remedy regardless of the above refund terms. Nothing in this policy limits your rights under the Competition and Consumer Act 2010 (Cth).
7. Code of Conduct and Participant Obligations
Success in IOBC programs requires full commitment from all participants. By enrolling, you agree to:
- Arrive on time and attend all scheduled sessions for the duration of the program.
- Be fully present and participate actively in all program activities, including coaching exercises, group discussions, and experiential learning.
- Engage with integrity and honesty in all discussions and interactions.
- Be respectful of fellow participants, facilitators, and IOBC staff — including silencing devices and avoiding disruptive behaviour.
- Embrace diversity and inclusion, and respect the dignity of all participants.
- Notify your facilitator as early as possible if circumstances may affect your ability to attend or participate fully.
For virtual sessions, participants are expected to join from a private space with reliable internet connection, using a suitable device (mobile phones are not recommended), and with camera on unless otherwise agreed.
IOBC reserves the right to remove any participant whose conduct is disruptive, inappropriate, or in breach of these Terms, without refund.
8. Incomplete Attendance Policy
IOBC's programs are designed to deliver a cumulative learning experience. Full attendance at all sessions is expected and required for program completion and certification.
If you become aware of any circumstances that may prevent you from attending all synchronous (real-time) program hours, you must notify IOBC in writing at [email] as soon as practicable. The following guidelines apply to IOBC's 3-day Certification Programs:

Participants who do not complete all required program hours will not be eligible for IOBC certification until attendance requirements are satisfied.
9. Intellectual Property
All course materials, frameworks, methodologies, models, tools, and content provided by IOBC (including text, graphics, logos, audio, video, and digital downloads) are the intellectual property of IOBC and are protected under Australian copyright law.
You may make a personal copy of materials provided to you solely for the purpose of viewing and personal use within the program. You must not otherwise reproduce, transmit, adapt, distribute, sell, modify, or publish any IOBC materials without prior written consent from IOBC.
10. Disclaimer on Advice and Outcomes
All information, content, and coaching methodology provided by IOBC through its programs, events, workshops, and communications is general in nature and is intended for educational purposes only. IOBC does not provide legal, financial, accounting, or regulated professional advice.
IOBC does not guarantee specific business outcomes, income results, or career outcomes from participation in any program. Every effort is made to ensure content is accurate and current; however, IOBC takes no responsibility for any inaccuracy, omission, or change in information provided during or after a program.
11. Limitation of Liability
To the maximum extent permitted by applicable law, IOBC excludes all liability to any person for loss or damage of any kind, however arising, whether in contract, tort (including negligence), statute, equity, or otherwise, arising from or relating to these Terms or any programs or services provided by IOBC.
Where any law (including the Competition and Consumer Act 2010 (Cth)) implies a condition, warranty, or guarantee that cannot be lawfully excluded, IOBC's liability for breach of that non-excludable condition will, at IOBC's option, be limited to:
- In the case of services: the supply of the services again, or the payment of the cost of having them supplied again.
Under no circumstances will IOBC be liable for any incidental, special, or consequential loss or damages, or damages for loss of data, business or business opportunity, goodwill, anticipated savings, profits, or revenue, arising in connection with these Terms or any program or service provided by IOBC.
12. Indemnity
You agree to indemnify IOBC and its directors, employees, contractors, and agents in respect of all liability for loss, damage, or injury which may be suffered by any person arising from your use of any IOBC program or service, or any breach by you of these Terms.
13. Privacy
IOBC collects and handles your personal information in accordance with its Privacy Policy and the Privacy Act 1988 (Cth). By registering with IOBC, you agree to be bound by the terms of IOBC's Privacy Policy, available at [website URL].
14. Amendment
IOBC may amend these Terms at any time by providing written notice to you. Your continued participation in any IOBC program following such notice will constitute your acceptance of the amended Terms. No other amendment to these Terms is effective unless made in writing by IOBC.
15. Assignment
You may not assign, novate, or otherwise transfer any of your rights or obligations under these Terms without the prior written consent of IOBC. IOBC may assign its rights and obligations under these Terms without your consent in the event of a corporate restructure, merger, or acquisition.
16. Entire Agreement
These Terms, together with IOBC's Privacy Policy and Refund Policy, constitute the entire agreement between you and IOBC in relation to your participation in IOBC programs and supersede all prior negotiations, arrangements, understandings, and agreements, whether express or implied, relating to that subject matter.
17. Waiver
No party to these Terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales and courts of appeal from them in respect of any proceedings arising out of or in connection with these Terms.
